Hiring and firing isn't always easy. Here, Ali Oromchian, Esq. on the three people dentist employers have to treat carefully to avoid legal problems.

The first tip I’d like to share with you today is one that you have to live by. There are three situations that you never, ever fire someone.

ONE

The first one is if they are pregnant.

TWO

The second is if they are old, and I’m sorry to say that in most states, “old” is defined as 50 years or above.

THREE

The third is if they’re hurt-if they’ve filed worker’s comp or if they’ve been hurt in the office in any way.

We had a famous case in California in which a dental assistant was going from dental office to dental office, running into x-ray machines. She would get time off, file disability and then come back and run into the x-ray machine again. We had to deal with her multiple times, unfortunately.

So, today's tip is simple: Never fire anybody who is pregnant, older or if they’re hurt.

 

Mr. Oromchian is the Co-Founder at HR for Health, and Partner at Dental & Medical Counsel, PC. He is a graduate of the University of California at Davis, where he received a dual Bachelor of Arts degree with Honors in Political Science and Rhetoric & Communications. He holds a law degree from the University of California, Davis School of Law.  During law school, Mr. Oromchian was the Editor-in-Chief of the Business Law Journal also worked for the Honorable Connie Callahan at the California Court of Appeals for the Third District. He also received an LL.M. in Taxation with Honors from The George Washington University Law School.  He is a member of the California and District of Columbia bars.

Mr. Oromchian’s family has made the San Francisco Bay Area their home for over 20 years.  He currently lives in San Ramon, with his wife Ozzie Jafarnia, a local pediatric dentist and daughters Caroline and Emme.
